Conclusions and recommendations of special procedures
Report of the Secretary-General
1. The Human Rights Council, in its decision 2/102, requested the Secretary-General
and the United Nations High Commissioner for Human Rights to continue their activities in
accordance with all previous decisions adopted by the Commission on Human Rights and
to update the relevant reports and studies.
2. The Commission on Human Rights, in its resolution 2004/76, requested the
Secretary-General to issue annually conclusions and recommendations of the special
procedures so as to enable further discussion of their implementation. The Commission also
requested the High Commissioner to continue to prepare a comprehensive and regularly
updated electronic compilation of recommendations made by the special procedures by
country, where such did not yet exist. In paragraph 29 of the annex to its resolution 65/281,
the General Assembly provided that the Office of the United Nations High Commissioner
for Human Rights (OHCHR) would continue to maintain information on special procedures
in a comprehensive and easily accessible manner.
3. The Secretary-General draws the attention of the Human Rights Council to the
conclusions and recommendations included in annual reports and the relevant addenda
thereto, submitted by the special procedures to the Council in 2018 at its thirty-seventh,
thirty-eighth and thirty-ninth sessions.1
4. In 2018, special procedure mandate holders presented 133 reports to the Human
Rights Council. They also presented 44 reports to the General Assembly. The
recommendations of special procedures are also available, searchable by country, in the
Universal Human Rights Index.
5. As illustrated by the list of themes addressed by special procedure mandate holders
in their reports in 2018 (see annex), a variety of issues has been examined, and States and
other stakeholders have been provided with advice on promoting and protecting human
rights at the national, regional and international levels. In producing their reports, mandate
holders have made specific recommendations that have been addressed not only to States

and other actors but also to the United Nations, as their reports also relate to various aspects
of the work of the United Nations.
6. Several reports related to the implementation of the Sustainable Development Goals.
They included the reports of the Special Rapporteur on the implications for human rights of
the environmentally sound management and disposal of hazardous substances and wastes,
the Special Rapporteur on the sale and sexual exploitation of children, including child
prostitution, child pornography and other child sexual abuse material, the Special
Rapporteur on the right to development, the Special Rapporteur on the rights to freedom of
association and of peaceful assembly and the Working Group on the use of mercenaries as a
means of violating human rights and impeding the exercise of the right of peoples to self-
determination.
7. Mandate holders also made concrete recommendations on how to enhance the
preventive approach of the United Nations by, for example, producing the joint study on
transitional justice and the prevention of atrocities referred to in paragraph 15.
8. Several reports related to migration issues. Those reports included those of the
Independent Expert on human rights and international solidarity, the Special Rapporteur on
trafficking in persons, especially women and children, the Special Rapporteur on
contemporary forms of racism, racial discrimination, xenophobia and related intolerance,
the Special Rapporteur on the right of everyone to the enjoyment of the highest attainable
standard of physical and mental health and the Special Rapporteur on torture and other
cruel, inhuman or degrading treatment or punishment. The focus of the reports of the
Special Rapporteur on the human rights of migrants was on returns and reintegration and
effective access to justice.
9. Economic issues were examined in such reports as that of the Special Rapporteur on
contemporary forms of slavery, including its causes and consequences, which related to the
impact of slavery and servitude on marginalized migrant women workers in the global
domestic economy. The reports of the Independent Expert on the effects of foreign debt and
other related international financial obligations of States on the full enjoyment of all human
rights, particularly economic, social and cultural rights, related, for their part, to the
development of guiding principles for assessing the human rights impact of economic
reform policies and the impact of economic policy reforms and austerity measures on
women’s human rights. The report of the Working Group on the issue of human rights and
transnational corporations and other business enterprises focused on the role of the State as
an economic actor, while that of the Special Rapporteur on extreme poverty and human
rights focused on the role of the International Monetary Fund and the impact of its
programmes on social protection.
10. Issues related to peace and security were addressed by the Special Rapporteur on the
right to food, who dealt with humanitarian crises, disasters and the right to food, and the
Special Rapporteur on the human rights to safe drinking water and sanitation, who reported
on access to water and sanitation for forcibly displaced persons. The right to education for
refugees was the focus of the Special Rapporteur on the right to education, while the
Working Group on mercenaries reported on the recruitment of children by non-State armed
groups, including mercenaries and private military and security companies. In addition, the
Special Rapporteur on the human rights of internally displaced persons proposed an agenda
for strategic and joint action on the occasion of the twentieth anniversary of the Guiding
Principles on Internal Displacement. The Special Rapporteur on trafficking in persons
examined the gender dimension of trafficking in persons in conflict and post-conflict
settings, in particular as it related to the women and peace and security agenda of the
Security Council. The Special Rapporteur on freedom of religion or belief studied the
relationship between freedom of religion or belief and national security. The Special
Rapporteur on extrajudicial, summary or arbitrary executions studied armed non-State
actors and the protection of the right to life. Finally, the Special Rapporteur on the
promotion and protection of human rights and fundamental freedoms while countering
terrorism addressed the impact on the protection and promotion of human rights and, inter
alia, international humanitarian law following the adoption of multiple resolutions
regulating terrorism by the Security Council in the period after 11 September 2001.
11. Emerging issues such as the impact of new technologies on human rights were
addressed in the reports of the Special Rapporteur on the promotion and protection of the
right to freedom of opinion and expression on artificial intelligence and on encryption and
anonymity, the report of the Special Rapporteur on the right to privacy on big data and open
data, the report of the Special Rapporteur on contemporary forms of racism, racial
discrimination, xenophobia and related intolerance on the contemporary use of digital
technology in the spread of neo-Nazi and related intolerance and the report of the Special
Rapporteur on violence against women, its causes and consequences, on online violence
against women.
I. Thirty-seventh session of the Human Rights Council
12. At the thirty-seventh session of the Human Rights Council, the following 19 special
procedure mandate holders, including the holders of 15 thematic and 4 country mandates,
presented their annual reports:
• Special Rapporteur on freedom of religion or belief
• Special Rapporteur on the right to food
• Special Rapporteur on the issue of human rights obligations relating to the enjoyment of a safe, clean, healthy and sustainable environment
• Special Rapporteur on adequate housing as a component of the right to an adequate standard of living, and on the right to non-discrimination in this context
• Special Rapporteur on the situation of human rights defenders
• Special Rapporteur on minority issues
• Special Rapporteur on torture
• Special Rapporteur on the sale and sexual exploitation of children
• Special Rapporteur in the field of cultural rights
• Independent Expert on the effects of foreign debt and other related international financial obligations of States on the full enjoyment of all human rights, particularly
economic, social and cultural rights
• Special Rapporteur on the rights of persons with disabilities
• Independent Expert on the enjoyment of human rights by persons with albinism
• Special Rapporteur on the right to privacy
• Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism
• Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence
• Special Rapporteur on the situation of human rights in the Democratic People’s Republic of Korea
• Independent Expert on the situation of human rights in Mali
• Special Rapporteur on the situation of human rights in Myanmar
• Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967
13. The Special Rapporteur on the situation of human rights in Eritrea participated in the
enhanced interactive dialogue on Eritrea, and the Independent Expert on the situation of
human rights in the Central African Republic participated in the high-level interactive
dialogue on the Central African Republic.
14. Thematic special procedure mandate holders presented reports on their visits to 18
countries and territories: Albania, Australia, Chile, Democratic People’s Republic of Korea,
Dominican Republic, Kazakhstan, Mexico, Mongolia, Panama, Serbia and Kosovo, 2
Switzerland, Tunisia, Turkey, United Republic of Tanzania, Uruguay, Uzbekistan and
Zambia.
15. The Special Rapporteur on the promotion of truth, justice, reparation and guarantees
of non-recurrence presented a joint study with the Special Adviser to the Secretary-General
on the Prevention of Genocide on the contribution of transitional justice to the prevention
of gross violations and abuses of human rights and serious violations of international
humanitarian law, including genocide, war crimes, ethnic cleansing and crimes against
humanity, and their recurrence. The study was submitted pursuant to Human Rights
Council resolution 33/19.
16. In its resolution 34/23, the Human Rights Council requested the Special Rapporteur
on the situation of human rights in the Islamic Republic of Iran to submit a report at its
thirty-seventh session. As the mandate holder passed away on 11 February 2018, her report,
as shared with the Government of the Islamic Republic of Iran on 25 January 2018, was
transmitted to the Council by the Coordination Committee of Special Procedures.
17. The Special Rapporteur on minority issues presented a report containing the
recommendations made at the tenth session of the Forum on Minority Issues, which was
held on 30 November and 1 December 2017 and focused on minority youth and progress
towards inclusive and diverse societies.
18. The Independent Expert on the enjoyment of human rights by persons with albinism
presented reports on the expert workshop on witchcraft and human rights and the Regional
Action Plan on Albinism in Africa (2017–2021).
19. The Special Rapporteur on human rights and the environment presented a report on
the expert seminar on best practices, lessons learned and the way forward with regard to
human rights obligations relating to the enjoyment of a safe, clean, healthy and sustainable
environment.
20. The special procedures also presented their communications report, which contained
communications sent by all mandate holders between 1 June and 30 November 2017. The
Special Rapporteur on the situation of human rights defenders presented reports containing
observations on the communications that had been transmitted to Governments and the
replies that had been received.
21. The Chair of the Coordination Committee of Special Procedures presented the report
on the twenty-fourth annual meeting of special rapporteurs/representatives, independent
experts and Chairs of working groups of the special procedures of the Human Rights
Council, including updated information on special procedures. The report was accompanied
by an addendum with relevant facts and figures.
II. Thirty-eighth session of the Human Rights Council
22. At the thirty-eighth session of the Human Rights Council, the following 19 special
procedure mandate holders – including the holders 17 thematic and 2 country mandates –
presented their annual reports:
• Special Rapporteur on extreme poverty and human rights
• Special Rapporteur on the right to health
• Special Rapporteur on the independence of judges and lawyers
• Special Rapporteur on the human rights of internally displaced persons
• Special Rapporteur on the rights to freedom of peaceful assembly and of association

23. The Council heard an oral update from the Special Rapporteur on the situation of
human rights in Myanmar and the Independent Expert on the situation of human rights in
the Central African Republic.
24. In addition, mandate holders reported on their visits to 21 countries and territories:
Argentina, Armenia, Australia, Bahamas, Canada, Chad, Côte d’Ivoire, Cuba (two visits),
El Salvador (two visits), Ghana, Indonesia, Iraq, Liberia, Libya, Mexico, Nepal, Niger, Peru,
Poland, Samoa and United States of America.
25. The Special Rapporteur on the right to freedom of opinion and expression also
presented materials supplementing his annual report (A/HRC/38/35). The public and
private regulation of user-generated online content is examined in that report. He also
presented a report in follow-up to his report to the Council in 2015 on the use of encryption
and anonymity to exercise the rights to freedom of opinion and expression in the digital age
(A/HRC/29/32).
26. The Working Group on business and human rights presented a report on the third
regional consultation for Latin America and the Caribbean on public policy for the
implementation of the Guiding Principles on Business and Human Rights in the framework
of the 2030 Agenda for Sustainable Development. The consultation was held from 12 to 14
December 2017 at the Economic Commission for Latin America and the Caribbean in
Santiago. The Working Group also presented a report describing the proceedings and
thematic recommendations of the sixth Forum on Business and Human Rights, held from
27 to 29 November 2017 in Geneva.
27. The Special Rapporteur on contemporary forms of racism, racial discrimination,
xenophobia and related intolerance presented a report on combating glorification of Nazism,
neo-Nazism and other practices that contribute to fuelling contemporary forms of racism,
racial discrimination, xenophobia and related intolerance.
28. The mandate holders also presented their communications report, which contained
the communications that had been sent by all mandate holders between 1 December 2017
and 28 February 2018. The Special Rapporteur on extrajudicial, summary or arbitrary
executions presented reports containing observations on the communications that had been
transmitted to Governments and the replies that had been received.
III. Thirty-ninth session of the Human Rights Council
29. At the thirty-ninth session of the Human Rights Council, the following 17 special
procedure mandate holders, including holders of 13 thematic and 4 country mandates,
presented their annual reports:
• Independent Expert on the promotion of a democratic and equitable international order
• Special Rapporteur on the implications for human rights of the environmentally sound management and disposal of hazardous substances and wastes
• Special Rapporteur on the rights of indigenous peoples
• Working Group on mercenaries
• Independent Expert on the enjoyment of all human rights by older persons

30. Special procedure mandate holders also presented reports on their visits to 19
countries and territories: Argentina, Denmark and Greenland, Ecuador, Gambia, Georgia,
Ghana, Guatemala, Guyana, India, Mexico, Mongolia, Montenegro, Paraguay, Sierra Leone,
Spain, Sri Lanka, Syrian Arab Republic, Venezuela (Bolivarian Republic of) and the
European Union. The Working Group on Enforced and Involuntary Disappearances
presented a report in follow-up to its missions to Croatia, Montenegro, Serbia and Kosovo.
31. The Special Rapporteur on the rights of indigenous peoples presented a summary,
jointly prepared with the Rapporteur on the Rights of Indigenous Peoples of the Inter-
American Commission on Human Rights, of a working meeting on the rules of
international law relating to the human rights of indigenous peoples in voluntary isolation
and initial contact in the Amazon and the Gran Chaco.
32. The Working Group on Arbitrary Detention presented a report on revisions to its
methods of work. The Working Group on Enforced and Involuntary Disappearances, for its
part, submitted a report on enforced disappearances in the context of migration. The Special
Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence
presented a global study on transitional justice.
33. The special procedure mandate holders also presented their communications report,
which contained the communications sent by all mandate holders between 1 March and 31
May 2018.
