24/2.
Local government and human rights
The Human Rights Council,
Recalling Human Rights Council resolutions 5/1 of 18 June 2007 and 16/21 of
25 March 2011, and Council decision 6/102 of 27 September 2007,
Recalling also the mandate of the Human Rights Council, as set forth by the General
Assembly in its resolution 60/251 of 15 March 2006,
Taking note of Advisory Committee action 9/1 of 10 August 2012 on research
proposals,1 which includes a research proposal on local government and human rights,
presented to the Human Rights Council for its consideration and approval in accordance
with its functions as described in paragraphs 75 to 78 of the annex to Council
resolution 5/1,
Bearing in mind that human rights and fundamental freedoms are the birthright of all
human beings, and that their protection and promotion is the first responsibility of
Governments,
Recognizing the role of local government in the promotion and protection of human
rights, without any prejudice to the primary responsibility of the national government in
this regard,
Recognizing also that local government has different forms and functions in every
State in accordance with its constitutional and legal system,
Taking note of relevant international and regional initiatives to promote human
rights at the local level,
The resolutions and decisions adopted by the Human Rights Council will be contained in the report of the Council on its twenty-fourth session (A/HRC/24/2), Part One.
1. Requests the Human Rights Council Advisory Committee to prepare, from
within existing resources, a research-based report on the role of local government in the
promotion and protection of human rights, including human rights mainstreaming in local
administration and public services, with a view to compiling best practices and main
challenges, and to present a progress report on the requested research-based report to the
Human Rights Council at its twenty-seventh session, for its consideration;
2. Also requests the Advisory Committee to seek the views and inputs of
Member States, relevant international and regional organizations, the Office of the United
Nations High Commissioner for Human Rights and relevant special procedures, as well as
national human rights institutions and non-governmental organizations, in order to prepare
the above-mentioned research-based report;
3. Encourages the Advisory Committee, when elaborating the above-mentioned
report, to take into account, as appropriate, the recommendations made by the human rights
treaty bodies, at the universal periodic review and by the special procedures, as well as the
work done on the issue by relevant United Nations agencies, funds and programmes within
their respective mandates.
